A 60-year-old man faces felony charges after Collier County sheriff’s detectives say they found a poolside marijuana grow operation at his North Naples home on Wednesday.

David Scott Krause, 151 Conners Ave., was arrested on charges of manufacturing marijuana and possession of marijuana over 20 grams, both felonies. He also was charged with possession of narcotic paraphernalia, a misdemeanor.

Detectives with the Sheriff’s Office’s Vice and Narcotics Bureau conducted an investigation at Krause’s home after receiving a tip about a possible marijuana grow operation, according to sheriff’s reports.

Sheriff’s reports gave this account:

Detectives walked up the driveway and immediately smelled a strong odor of marijuana coming from the garage. One of the garage doors was wide open and detectives could see two marijuana buds hanging on a string drying in plain view. They made contact with Krause’s wife, who gave detectives written and verbal permission to search the residence.

Krause arrived at the home while detectives were there.

They found four marijuana plants that were growing in pots by the outdoor pool. The plants had an estimated street value of $12,000.

The search also turned up some more marijuana in a vehicle at the residence, along with 5.9 grams of suspected hashish and six marijuana pipes containing marijuana residue. The additional marijuana had an estimated street value of $1,500.

This year, detectives have shut down six marijuana grow operations in Collier, making five arrests and uncovering a total of 124 plants with a combined estimated street value of $372,000, the Sheriff’s Office reported. Five of the grow operations were inside residences and one, Krause’s operation, was outside. Detectives have also seized two firearms and $20,500 in U.S. currency in 2012.

In 2011, detectives seized a total of 447 marijuana plants with a combined estimated street value of $1.3 million from 14 marijuana grow operations. Nine were indoor grow houses and five were outdoor operations. Children were discovered in two of the indoor grow houses.

The United States locks up more people than any other country in the world - no matter how you try to spin the statistics, no matter how you count it - we're WAY out front. What does it cost us to confine 2 million people? On average, around $45,000 per year! That works out to $90,000,000,000. That's 90 Billion per year! MOST of those people that we're paying so much money to detain are there for NON-VIOLENT drug related charges...

$90 Billion/year - That's not even counting the money spent on catching these people, or the lost revenue from sales and income taxes, or the ruined lives of the kids that get into the drug trade. (That's another $40 Billion / year)

If only a portion of that money were spent on treatment and not incarceration - we would be FAR better off!

End the War on Drugs! We can't afford it!

Spare us the "What about the children" rational.

Marijuana is less dangerous to society than many legal substances and foods people consume daily. Have you read the news lately about Ammonium Hydroxide in McDonald's hamburgers? How about the recent scientific study that shows that sugar, in high doses, is nearly as toxic to the body as alcohol? These things cause obesity, diabetes, cancer, and a host of other preventable illnesses and deaths. Marijuana causes few ill effects apart from possibly making you lazy, and even then it depends on the individual.

This is about money and the fact there is more to be made by outlawing Marijuana than legalizing and selling it. If it were legal, this guy could do just what he was doing and no one would make squat except the company he bought seeds and grow equipment from. Because it's illegal, cops, lawyers, counselors, probation officers, judges all have jobs which in a logical world would seem like a waste of money and law enforcement resources.

Marijuana's prohibition has nothing to do with "protecting the children" and everything to do with propping up an unjust, unconstitutional system.

Oh and you also spelled "Dumber" wrong; which is quite ironic.

Hate to burst your bubble, but I've been told that's exactly why they won't legalize it. It's so easy to grow that the best minds around can't figure a way to tax it.

If you can figure a way to tax it (Grower's License?... fat chance of that working), contact your Congressman. It's like growing tomatoes or zucchini at home... or petunias. No good way to tax it.

A "street value" of $12k?

Admittedly, narcotics traffiking is a problem, but marijuana is not a narcotic, nor is this guy selling his four plants for 12k.

This is idiotic.

If I were on the jury for this case, I woulkd be very tempted to refuse to convict, regardless of the "experts" who claimed this was worth $12k "on the street".

Mostly I think "jury nullification" is a bad idea, but I think it would be proper here.

Poor guy, if only people would wake up and realize that "Marijuana" is a PLANT. Yes, you may be thinking, WAIT? Does that mean it is the exact same life form as grass or maybe even a dandelion? It isn’t some cooked up brain cell killing chemical? Yes you are correct! Marijuana is just a plant. It is not cooked in labs, extracted, etc. It is just a PLANT. A plant that is putting 3rd time non-violent offenders, such as Mr. David Krause, in jail for a long time. Now, besides wrecking his life, our government is spending in excess of $40,000 to keep him in jail and tens of thousands of others like him as well. As Americans, we should be asking ourselves this question; Should we spend $40,000 a year keeping men and women like this in jail (again, for non-violent offenders A.K.A people using marijuana for recreational use) for ingesting a plant? Of course not, you might as well be saying if I go outside and harvest a dandelion and smoke it, I am committing a felony! HA

Some people call the “war on drugs” a joke; I do not. The war on drugs has been diverted off the original path. We need to legalize marijuana across the board and let the states decide whether or not they would like it legalized, and allocate the rest of that money on a REAL war on drugs. Go after crack, cocaine, METH, heroin, PERSCRIPTION DRUGS ABUSERS.

I’ll let you decide what you think after reading that—Oh wait! Did I mention it has medical properties as well such as treating glaucoma? I didn’t? I’ll save that for another comment, I think I made my point.

This is really a waste of law enforcement and money. They should be going after the real criminals in our society like attorney general Eric Holder and his boss Obama for the Fast and Furious mess that they invented to try and turn the American people against the legal ownership of firearms. They ended up getting a border agent killed along with many innocent Mexicans by flooding the border with guns and not tracking them. It was all a hoax that ended up biting them in the rear. Holder is lying to congress about it again today.
The border agents family is now suing our government and I hope they win.
They did this without informing the Mexican authorities.
The Bush administration did a similar operation in cooperation with the Mexican government called Wide Receiver. They actually tracked the guns though. The program was discontinued.
Many try to confuse the latter with the former while trying to make excuses for the criminals that are now running our country. Their motives were completely opposite. Bush and the Mexicans were trying to apprehend criminals while the Obama administration did it for the purpose of trying to get rid of the 2nd amendment.

Don’t forget jails/prisons. Much of it is privatized for profit. Big money buys lobbyists. Lobbyists get things done. Regarding the children, no, kids shouldn’t be exposed to it until they are old/competent enough and or responsible enough to deal with any consequences (good or bad) of use or affiliation with pot. I can say this, in school and in the military, I knew good people/kids who literally overdosed on alcohol. In fact alcohol poisoning kills an average of 317 people per year in the US. Pot overdoses ZERO. "Stupid is as stupid does"? Really of all the amazing people and quotes available to us at our finger tips via the internet, I don't see Gump as the go to guy. Or again, perhaps it’s just irony. What's even more ironic is how and why people know "there are so many children who live in around that place".

The war on marijuana is one of the worst scams ever perpetrated on the American people. The sooner this latter-day Prohibition is ended the better for ALL of us. Imagine police actually having to hunt down and confront REAL criminals! Imagine Mexican drug cartels having to disband because their business model has collapsed. Imagine the prison population cut in HALF! Imagine millions of law-abiding citizens with no arrest records. Imagine the federal budget balanced on the taxes raised and the expenses saved.

I hope it is soon!
