Teens riding ATV hospitalized after crash with car

A crash Monday night involving an ATV and a car left a 14-year-old in critical condition and a 16-year-old in serious condition.

Raul San Pedro, 14, was driving the ATV east on 43rd Avenue NE, east of Everglades Boulevard in Golden Gate Estates just after 4:30 p.m. next to another ATV.

Mark Tirado, 58, was driving a 2002 Acura eastbound on the road.

The Florida Highway Patrol reports that Tirado’s car hit the back of the ATV, causing it to flip several times and then throwing San Pedro and Andrew Fernando Garcia, 16, both of Naples.

Both teens were initially taken to Lee Memorial Hospital. San Pedro was then transferred to Tampa General, according to FHP.

Tirado suffered minor injuries and was treated at Physician's Regional Medical Center.

Charges in the crash are pending, according to the FHP.

POSTED EARLIER

Three people were hospitalized Monday afternoon after an all-terrain vehicle collided with another vehicle near Orangetree.

Two people were taken to Lee Memorial Hospital and a third was taken to a Collier County hospital after the vehicles crashed around 4:45 p.m. near the intersection of 43rd Avenue Northeast and Everglades Boulevard North, said Lt. Greg Bueno, a Florida Highway Patrol spokesman.

As of 8:30 p.m., troopers still were at the hospital and FHP did not have updated information on the patients’ conditions or identities, Bueno said. More information is expected to be released later Monday.

The ATV's are at fault as ATV's are not street legal! They are restricted from being driven on public roads!

See this on a daily basis in San Carlos Estates in Bonita Springs. ATV's are not to be driven on the road, just a matter of time before this happens again. Parents even come to the bus stop to pick up small children on their ATV, no safety equipment and little common sense

Not only are the ATVs prohibited on the road, they are also prohibited from operating on the right of way (you know, that land we have to pay taxes on but can't use)and on private property without the consent of the owner.

I'm tired of the dirt bikes and ATVs tearing up my grass out by the street and trespassing in the rear of my lot.

The County Commissioners need to pass an ordinance with teeth in it to prevent these kids, and adults, from operating these things off of their own property. How about confiscation of the ATV until Daddy comes down town and pays a $500 fine?

Have any of you thought that maybe the driver is the one at fault? Do any of you know how fast he was going? Was he drunk or stoned? And I know that the papers keep saying it was an ATV, it was a Rhino - a utility vehicle like a golf cart. Stop blaming the CHILDREN and put the blame where it actually belongs - We live in the estates and know that the children are out there on these machines, so drive accordingly. Also, the speed limit on that road is 30 MPH - with the damage to the car there is NO WAY the driver was only going that fast - and the sport utility vehicle had flipped over several times - 30 MPH???? again NO WAY

i have to give your thought a 100% cause i was thinking even thou the atv if it was one that they were on , and it is not street legal , should never be rear ended ( just as nothing else should be rear ended ) was the driver of the car paying any attention that he would rear end anything in his path !!! unless the vehical in question turned in front of him and he didn't have enough time to react and slow down to keep from hitting them !!! just cause the atv ( if it was one ) was on the road , doesn't make him guilty !!! children are not allowed to play on the road but most of us grew up doing just that , and thank God most of us didn't get hit by a car !!!

Even if the authorized motor vehicle were running at 101mph like CCSO's Cpl. Jesse Todd does when he kills innocent motorist's, the high percentage of fault lies with the ATV driver as it is prohibited from public roads. The accident would not have occurred if the ATV was not being operated illegally on a public roadway!

But, if Tirado was operating the Acura without a license, registration, and/or insurance, both are at fault.

If a person doesnt have a license, insurance, or registration, that doesnt stop him/her from driving they just cant do it legally, having or not having a piece of paper doesnt physically stop,or permit someone to get behind he wheel and drive.they'll do it regardless.

I hunted down some information, and I think the number of deaths are similar, despite the vastly greater number of bicyclists. Here are the citations for the information, and please forgive if I have interpreted the numbers incorrectly:

The first is from the CDC: http://www.cdc.gov/HomeandRecreational Safety/bikeinjuries.html

I agree, see this everyday, ATV's tearing up the swales in the community & trespassing on private property. The sad thing is many think it is completely legal or just dont care. Play with your toys on your own property and stay off the roads. Call the sheriff when you see this and eventually they will start handing out some citations

The location of this accident is on a dead end street about half way down to the end of the road. There is no intersection. The Utility vehicle in question was going east at about 20 miles per hour. The car hit the utility vehicle from behind causing it to flip over several times. The car must have been traveling at a high rate of speed. There were no skid marks until after the car hit the off road vehicle. It was day light with the sun setting behind the driver of the car. The visibility was excellent. Only a blind or impaired driver would not be able to see the off road vehicles. If you were on a bicycle, a motorcycle or walking down the road you would have been hit. Lucky they were in an ATV or they would not even have a fighting chance. When you are driving down the road and you see a child playing on the side of the road, a jogger, a bicyclist, or an animal do you slow down or speed up?

Thanks for the information. I find ATV's far more dangerous to ride, especially on pavement.
I do find it ridiculous that parents buy their kids toys like ATV's that cannot be legally ridden anywhere.
That equates de-facto permission to ride in the road or across their neighbor's land.

Facts do not matter to 'swampbug'however, as he has a "conservative" agenga that features intolerance for bikers as well as hikers, kayakers, canoests, runners, sailers and basically anyone that recreates or travels without using a combustible engine.

I am neither small minded nor dim witted. I am educated, I do accept responsibilty for my actions. DO YOU? You however fail to accept the reality of wrong doing, on the part of the parents for allowing such access and activity.
